Intek-Resources - Terms and Conditions for jobseekers

Trading Terms and Conditions of Intek-Resources ("Intek-Resources ").

Intek-Resources is fully compliant with the Data Protection Act 1998 and the EU Directive on Private Electronic Communications as of 12th December 2003. Intek-Resources is registered for the purpose of 'the collection and dissemination of the details of persons seeking employment through various employment agencies and employers' job descriptions with the aim of matching one to the other'.

The following terms and conditions of trading are deemed as acceptable by a Intek-Resources Candidate and consent to data process information, as provided by a candidate, is given. Such consent is stated on selection of the 'I have read and accept the terms and conditions' drop down text box followed by the clicking on the 'proceed' button, at the registration page.

1 Obligations of Intek-Resources.

(a) Intek-Resources will match clients' Job Specifications with candidates' registration and job alert information wherever possible;
(b) to comply with the Data Protection Act, 1998;
(c) to process personal sensitive data in accordance with the Data Protection Act, 1998;
(d) not to disclose personal sensitive data concerning race or ethnic origin to any employer or employment company, unless the Candidate has applied to a specific position, through the Intek-Resources site, which requires such information, wholly for the purposes of ethnic monitoring in the context of implementing equal opportunities;
(e) to only disclose personal sensitive data concerning any disability, as defined by the Disability Discrimination Act 1995, that the Candidate may have, to an employer or employment company, for the purposes of enabling fair access to the recruitment process and not in any way for reasons of discrimination and if the Candidate has applied to a specific position, through the Intek-Resources site, which requires such information;
(f) to comply with the EU Directive on Personal Electronic Communications, specifically to provide an unsubscribe facility with every Intek-Resources jobs and career news related email that is sent, as job alerts and registration details are password protected Candidates must login to the Intek-Resources site to unsubscribe themselves from these job seeker functions.

2 Obligations of the Candidate

 The Candidate agrees: 
(a) to provide Candidate Information which is in all respects true and is not, in any respect, misleading, deceptive or inaccurate or likely to mislead or deceive;
(b) to explicitly give consent for the processing of all personal sensitive data;
(c) not to provide information or perform or cause to perform any act or action which will, or be likely to, cause the service and or services operated and provided by Intek-Resources disrepair, damage, failure or fall into disrepute;
(d) not to communicate malicious or offensive material in response to an advertisement on the Intek-Resources or any Intek-Resources Client sites

3  Acknowledgements, warranties and representations

 The Candidate acknowledges that: 
(a) the Candidate takes responsibility for the accuracy or otherwise of the Data supplied by the Candidate;
(b) no proprietary right accrues to the Candidate in any software, information, material or methods supplied by Intek-Resources ;
(c) the Candidate has not relied upon any warranty representation or assurance which may have been given by Intek-Resources as to the success of the Intek-Resources site;
(d) that Intek-Resources may alter or delete Candidate Information at any time without prior notice, anonymous Candidate information will be stored by Intek-Resources for up to six years in compliance with the DPA;

4  Indemnity

The Candidate indemnifies Intek-Resources against claims brought against Intek-Resources by a third party and damage suffered by Intek-Resources in respect of Intek-Resources or an Employer's use of any Candidate Information including claims relating to the Data Protection Act, 1998.

5  Governing law, jurisdiction and representation

 This agreement is governed by the laws of the United Kingdom and the parties irrevocably submit to the jurisdiction of its courts.

6  Variation of terms

Intek-Resources reserves the right to vary these terms and conditions at any time, without prior notice.

7 Disclaimer

Subject to the provisions of the Unfair Contract Terms Act 1977, the Supply of Goods and Services Act, 1982 and otherwise by law, Intek-Resources disclaims all warranties in relation to Intek-Resources, the software and the Data including all warranties implied by law or statute in relation to merchantable quality and fitness for purpose.
